'American philosopher and lawyer Richard Wasserstrom (1961) sought a systematic understanding of the behavior of judicial justifications in decision making. In The Judicial Decision: Toward a Theory of Legal Justification, Wasserstrom demonstrated that in dealing with precedent and balancing utility, judges were required to decide and justify their decisions with appropriate justifications. Judges needed to justify why they decided as they did. Wasserstrom further demonstrated that judicial justifications were substantively distinct from the choice of interpretation style; whereas the choice of interpretation style affected the meaning of the law, the choice of justification affected the justice of a conflict resolution. Justification, for Wasserstrom, is more than a choice of how to interpret; it metes out justice. It makes one accountable for the decisions made. It does not allow judges to come to a decision without appropriate forensic or moral supporting arguments.
